Domestic Violence Attorney in Wichita

While there are fewer studies regarding domestic violence statistics in same-sex relationships than in heterosexual relationships, the laws impacting lesbian, gay, bisexual, and transgender individuals have rapidly changed over the past few years, creating an unprecedented degree of visibility among the LGBT community. With this increase in visibility comes additional discussions regarding the difficulties that LGBT couples face, including the rates of domestic violence among same-sex couples. Is domestic violence as likely to occur in same-sex relationships as heterosexual relationships, and if so, does the type of violence differ? Jonathan W. McConnell, founding domestic violence attorney in Wichita, Kansas, at the McConnell Law Firm, works to answer these questions below!

Rates of Reported Domestic Violence

According to The National Intimate Partner and Sexual Violence Survey conducted by the Centers for Disease Control (CDC), incidents of domestic violence among same-sex couples generally occur at the same rates as amongst heterosexual couples, with the rates of sexual violence somewhat lower for women in lesbian relationships than heterosexual women. Dissimilarly, the rates of partner violence among gay men appear to be much higher than rates of domestic violence experienced by heterosexual men.

“In my experience, there are many more incidences of domestic violence amongst gay male couples that go unreported,” said Jonathan W. McConnell, founding domestic violence attorney at the McConnell Law Firm. “While abuse is prevalent in gay relationships, the instances of domestic violence that have been reported are but a tiny drop in the bucket when it comes to actual instances.”

Types of Domestic Violence

Overall, the number of domestic violence accusations made by same-sex couples are the same as with heterosexual couples, with the type of domestic violence that occurs being generally the same as well. Some of these typical patterns of abuse experienced by both heterosexual and same-sex couples include:

  • Physical violence
  • Psychological abuse
  • Sexual violence
  • Withholding of resources
  • Intimidation or fear tactics

In addition to these common types of domestic violence experienced by both same-sex and heterosexual relationships, many times, abusive individuals in same-sex relationships may do things like threatening to “out” their partner or feel less guilty about engaging in physical confrontations with their partner. Ultimately, this type of abuse may lead to law enforcement determining the violence has occurred “among equals,” disregarding the power imbalance inherent in many abusive relationships.

“The type of abuse experienced by same-sex couples is typically the same as with heterosexual couples,” said McConnell. “Many times, a more dominant partner will take advantage of the less dominant partner, or if drugs and alcohol are involved, that heavily affects an individual’s ability to understand what they are doing, which often results in these instances of domestic violence.”
