A Landmark Defense Victory

Casper v. Kansas Dep’t of Revenue – 309 Kan. 1211, 1212, 442 P.3d 1038, 1039 (2019)

Outcome: Kansas Supreme Court upheld District Court’s Dismissal of Action Against Client’s Driver’s License; Not guilty of DUI Verdict at Bench Trial

Opinion Filed: 6/14/2019

Issue: Driver’s License Suspension Following a DUI Arrest

Summary: In October of 2013, a routine traffic stop that turned into a DUI investigation later became a pivotal case for Kansas DUI law. Handled by the McConnell Law Firm’s founding attorney, Jonathan W. McConnell, the Casper v. Kansas Dep’t of Revenue case is relied upon daily by criminal defense attorneys throughout Kansas when defending clients who have been falsely arrested for DUI. McConnell successfully argued the case to the highest court in Kansas, the Kansas Supreme Court, which ultimately agreed that the agency action taken by the Kansas Department of Revenue in suspending Casper’s license was not supported by the evidence. With the McConnell Law Firm’s relentless advocacy, Casper avoided both a lengthy driver’s license suspension and an ignition interlock device requirement. In the criminal case, Casper was acquitted of driving under the influence by a judge at a bench trial.
