Who Is Required To Register?
There are a wide variety of sexual offenses that can require a convicted party to register as a sex offender in the state of Kansas, from sexual assault or abuse of a minor and statutory rape charges to prostitution and indecent exposure. The requirements and obligations of your registration will vary depending on your criminal conviction, but generally, any adult convicted of a crime outlined in KSA 22-4902 can be required to register as a sex offender. In the case that a juvenile is adjudicated of a sex crime, they can be required to register as a sex offender in the state of Kansas for five years, which can be public or private.
What Are the Requirements for Registration?
Because registration in Kansas is considered a civil issue as opposed to a criminal issue, it is possible that the government could alter the duration for registration (ex-post facto application of a law). If you are required to join the sex offender registry in the state of Kansas, there are some additional reporting obligations you will be required to abide by. These include:
- Registering with local law enforcement within three days of residing, securing employment, or attending school in a new county.
- Registering in person with local law enforcement within three days of beginning, changing, or ending residence, employment, or school. You must also provide written notice of any change to the Kansas Bureau of Investigation.
- Registering four times a year in person with local law enforcement—once during the month of the offender’s birthday and every third, sixth, and ninth month. During this time, you will be required to pay a $20 fee, be photographed, and verify your current address, contact, vehicle, and employment information.
- Registering every 30 days in person if you are transient.
- Registering after traveling to and spending more than three days in another state.
- Navigating specific country requirements and regulations when traveling internationally.
Can I Be Removed From the Registry?
It’s important to understand that a sex offender registration doesn’t have to be a lifetime burden that restricts where you can reside and what you can do. Registration terms in Kansas, for an adult, can be 15 years, 25 years, or a lifetime. Unfortunately, there is no mechanism to remove yourself from the sex offender registry early; however, the state of Kansas has one of the least restrictive registration rules in the country. Our sexual assault attorneys in Wichita at the McConnell Law Firm recommend partnering with an experienced sexual assault attorney to ensure you meet all requirements for registration, as failure to register can result in a presumptive prison felony charge.
