It may not seem right to be prosecuted for a drug that’s legal in other states, but in Kansas, marijuana crimes are still a reality. And even though there have been changes to Kansas law that downgrade penalties for first-time simple possession, there are still consequences you might not expect.

The marijuana lawyers at the McConnell Law Firm know the law inside and out. From years of experience, we know the defense tactics most likely to produce the best possible outcome.

  • Your marijuana lawyer may be able to win an acquittal or dismissal of your charges.
  • If you’re facing a marijuana-related DUI, we may be able to reduce the impact on your driving record and improve the chance of keeping your auto insurance.

What to Expect

Request A Consultation

Free Introductory Phone Call

A receptionist or legal assistant will gather information about your case. This usually takes about 30 minutes.

If your case is within the type of law we practice, we can schedule a free office or phone consultation with one of our marijuana attorneys. If not, we will do our best to refer you to a law firm that can help.

Information-Gathering

We will likely ask you for more information during or after the first phone call. It will be your task to gather this information, which will help us research the specific laws that may apply to your situation.

Free Consultation

You will consult with a marijuana lawyer for about an hour. This is a chance to get to know the attorney and see if they’re a good fit for you.

The attorney will share their analysis of your situation and recommend next steps. They will also tell you about anything we need to get started.

This first consultation does not create an attorney-client relationship. Our firm must have a signed agreement to represent you.

We Get to Work

If you decide to hire us, we will enter into a signed contract. You will make your payment for our services.

Once these steps are complete, we can officially represent you as your legal team. We will keep you informed about the status of your case so you’re always in the loop.

Even though marijuana possession is still illegal in Kansas, the state recently updated its laws to reduce the penalty for first-time simple possession.

Penalties are tiered based on the amount of marijuana in your possession and your criminal history at the time of the arrest. First-time marijuana possession is considered a Class B misdemeanor and can incur a fine of up to $1,000 and up to six months in jail.

This applies to small amounts of marijuana (less than 25 grams) with no indications of an intent to distribute. Possession of larger quantities may indicate an intent to distribute, which is a felony drug crime under Kansas law.

The cultivation of marijuana is a felony charge in Kansas, with penalties based on the amount found, any prior criminal history, and other potential factors. If you’ve been arrested for or charged with growing marijuana, you should contact an experienced marijuana attorney now.

Yes. If a police officer believes you’re operating a vehicle under the influence of marijuana, you can be charged with Driving Under the Influence (DUI).

Kansas Statute KSA§ 8-1567 defines DUI as operating or attempting to operate any vehicle while:

  • The alcohol concentration in the person’s blood or breath is 0.08 or more
  • Under the influence of alcohol to a degree that renders the person incapable of safely driving a vehicle
  • Under the influence of any drug or combination of drugs to a degree that renders the person incapable of safely driving a vehicle
  • Under the influence of a combination of alcohol and any drug or drugs to a degree that renders the person incapable of safely driving a vehicle

Yes. Possessing marijuana is illegal in Kansas, even if you obtained it legally in another state. Travel between state lines with marijuana (or any illegal drug) is especially risky, as it can constitute a federal offense due to its interstate nature.
