If you have been recently convicted of Driving Under the Influence (DUI), you may be on DUI probation, which comes with a list of mandatory promises that must be met. Terms of probation for a DUI conviction can include any of the following:

  • Participation in substance abuse or alcohol awareness classes
  • Use of an ignition interlock device
  • Prohibition against driving
  • Urinalysis testing
  • Alcohol intake monitoring (e.g., ankle bracelet)
  • Avoidance of additional criminal violations
  • Payment of fines
  • Community service
  • Payment of restitution to victims

“During your probationary period, you must report to your probation officer who is responsible for monitoring your adherence to the DUI probation terms,” said Criminal Defense Attorney Jonathan W. McConnell.

When a DUI Probation Term is Violated

Perhaps you have already violated one of your specific terms, or you think the likelihood of violating one is high. A minor violation might be arriving at a substance abuse class late, while a more serious violation would be committing another DUI. Regardless of the type of violation, it is at your probation officer’s discretion whether or not a report is made to the court, whereas a judge would then decide.

According to Avvo.com: “The severity of the violation will dictate the nature of the punishment, and more serious violations may cause the judge to impose the full sentence allowable by law, including putting the offender behind bars. Other consequences for a probation violation may be an extension of the original probation term, the imposition of additional requirements, or revocation of probation altogether in favor of a jail term.”
