The McConnell Law Firm in Wichita, Kansas, is often asked, “Can I lose my license immediately after being cited with Driving Under the Influence (DUI)?” Specializing in DUI defense, the McConnell Law Firm in Wichita, Kansas, has developed some brief information to answer that question.

Below are the associated events:

1. When arresting a person for a DUI, the officer will read the individual the implied consent notice from the DC-70 form. A person has 14 days from the date they receive the temporary driver’s license form (DC-27) to pay $50 and request the driver’s license administrative hearing. If they do not request the hearing in time, pay the $50 fee, or send the appropriate request, their driver’s license will be automatically suspended 30 days from the date they received the DC-27.

2. The length of the possible driver’s license suspension is based on the following factors:

  • How many DUIs they have had in the past
  • If they agreed to or refused to blow into the Intoxilyzer 9000
  •  If they blew into the Intoxilyzer 9000, how high they blew

3. The State has two chances to suspend and/or restrict someone’s license: through the driver’s license administrative hearing (civil side) and the criminal charges (criminal side).

For someone’s driver’s license to go “untouched,” they would have to win the driver’s license administrative hearing, AND either have the criminal case dismissed, win at trial, have it amended to a non-DUI, or enter into a diversion. Any deviation of the above will result in a suspension and/or restriction.
